In short
We collect the details you choose to send us, use them to reply and to work with you, never sell them, and keep them only as long as we need to. This website does not currently use analytics or advertising cookies.
01Who we are
Funtech Traffic is operated by Funtechtyco Limited, a company registered in Hong Kong, with its registered office at Unit 2610, APEC Plaza, 49 Hoi Yuen Road, Kwun Tong, Kowloon, Hong Kong (“Funtech Traffic”, “we”, “us”).
This policy explains how we collect, use, share and protect personal data when you visit funtechtraffic.com, contact us, or deal with us as a prospective or current client. We handle personal data in line with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong (the “PDPO”). Where the EU or UK General Data Protection Regulation applies to our processing, we are the controller of your personal data and this policy also explains your rights under those laws.
02Information we collect
Information you give us
When you use our contact form or email us, we collect the information you choose to provide, which may include:
- your name, work email address, company name and website;
- the services you are interested in and your business sector;
- the content of your message and any further correspondence with us.
Please do not send us sensitive personal data (for example health information or identity document numbers) through the contact form.
Information from working together
If you become a client, or work for one, we also hold business contact details and the information needed to provide our services, manage the relationship, and invoice and keep records.
Information collected automatically
Like most websites, the servers that host funtechtraffic.com may automatically record standard technical information, such as your IP address, browser type, the pages requested and the date and time of the request. This is used to deliver the website, keep it secure and diagnose problems.
The website does not currently use analytics, advertising or social media tracking cookies. See our Cookie Policy for details of the browser storage it does use.
03How we use your information
We use personal data only for the purposes it was collected for, or directly related purposes:
- to reply to your enquiry, understand your needs and prepare proposals;
- to provide and manage our services under an agreement with you or your organisation;
- to operate, secure, maintain and improve our website;
- to keep business and accounting records and meet our legal and regulatory obligations;
- to establish, exercise or defend legal claims.
Direct marketing
We will not use your personal data for direct marketing, or provide it to others for their direct marketing, unless you have given us your consent. You can withdraw that consent at any time, free of charge, by emailing [email protected] or by using the unsubscribe link in any marketing email.
04Legal bases for processing
If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases:
- Steps before a contract and performance of a contract, when we respond to an enquiry about our services or provide them.
- Legitimate interests, in running and securing our website, managing business relationships and developing our business, where these interests are not overridden by your rights.
- Legal obligation, where we must keep records or disclose information by law.
- Consent, for any direct marketing and for any non-essential cookies, which you can withdraw at any time.
05Who we share it with
We do not sell or rent personal data. We share it only where necessary, with:
- service providers who support our business, such as website hosting, email, form handling and IT providers, who may only use it on our instructions and must keep it confidential and secure;
- professional advisers such as lawyers, accountants and auditors;
- courts, regulators, law enforcement or other authorities where required or permitted by law;
- a buyer or successor if our business, or part of it, is reorganised, sold or transferred, subject to this policy.
06International transfers
We are based in Hong Kong and some of our service providers operate in other countries, so your personal data may be stored or processed outside the place where you live. When this happens we take reasonable steps to make sure it receives a level of protection comparable to this policy. For transfers of data from the EEA or UK, we use appropriate safeguards recognised by those laws, such as standard contractual clauses, where required.
07How long we keep it
We keep personal data only for as long as necessary for the purposes described in this policy. As a guide:
- enquiries that do not lead to a working relationship are generally deleted within 24 months of our last contact;
- client and project records are kept for the duration of the relationship and afterwards for as long as needed for contractual, tax, accounting and legal purposes;
- server logs kept by our hosting provider are retained for a limited period for security and troubleshooting.
08Security
We use reasonable technical and organisational measures to protect personal data against unauthorised or accidental access, processing, loss or use. Our website is served over an encrypted connection. No method of transmission over the internet is completely secure, however, so we cannot guarantee absolute security.
09Your rights
Under the PDPO
You have the right to ask whether we hold your personal data, to request a copy of it, and to ask us to correct it if it is inaccurate. We will respond to data access and correction requests within 40 days. As permitted by the PDPO, we may charge a fee for complying with a data access request that is not excessive. You can also ask us to stop using your data for direct marketing at any time.
Under the EU or UK GDPR
Where these laws apply, you may also have the right to request erasure of your data, restrict or object to its processing, receive it in a portable format, and withdraw consent at any time without affecting earlier processing.
How to make a request
Email [email protected] with “Data request” in the subject line. We may need to verify your identity before acting on a request. If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner for Personal Data, Hong Kong, or to your local data protection authority.
